- New Wave Financial Planning Pty Ltd (ABN 15 645 847 712), Corporate Authorised Representative of NWG Financial Services Pty Ltd (ABN 17 656 705 323, AFSL 538619), for financial planning and insurance services
- New Wave SMSF Pty Ltd (ABN 97 682 530 070), for legal services
- NWG Financial Services Pty Ltd (ABN 17 656 705 323, AFSL 538619), as the Australian Financial Services Licensee
Each entity is a data controller for the personal information it collects in connection with its own services.
This Policy explains how we collect, use, hold and disclose your personal information, and how we comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
For accounting and taxation services, this Policy reflects our obligations under the Tax Agent Services Act 2009 (Cth) and the Tax Practitioners Board (TPB) Code of Professional Conduct, including confidentiality obligations.
For legal services, information shared in the context of obtaining legal advice may be subject to legal professional privilege and is handled accordingly.
What Personal Information Do We Collect?
The types of personal information we collect depend on the services you engage us for, but may include:
- Full name, date of birth and contact details
- Identity documents such as a driver’s licence or passport
- Tax file number (TFN)
- Financial information including income, assets, liabilities, superannuation balances and investment holdings
- Employment history and occupation
- Estate planning details including beneficiary information
- Insurance information

- Health information (where relevant to insurance applications or claims)
- Details of your SMSF including trust deed, trustee details, fund investments and compliance history
We will always collect your personal information directly from you where possible. We may also collect information from third parties such as the Australian Taxation Office, ASIC, financial institutions, or other professional advisers, where this is necessary to provide our services and where permitted by law.
Tax File Numbers
We handle tax file numbers (TFNs) in accordance with the Privacy (Tax File Number) Rule 2015. We will only collect, use and disclose your TFN where authorised by law, and we will take reasonable steps to protect your TFN from unauthorised collection, use or disclosure.
How We Use Your Personal Information
We use your personal information to provide our services, including to:
- Provide accounting, taxation, SMSF, financial planning, insurance and legal services
- Establish, administer and manage your SMSF
- Prepare financial statements, tax returns, and compliance documents
- Provide financial advice and implement investment strategies
- Prepare Statements of Advice (SoAs) and Records of Advice (RoAs)
- Conduct identity verification and conflict of interest checks
- Correspond with the ATO, ASIC, APRA and other regulatory bodies on your behalf
- Send invoices and manage payments
- Keep you informed about changes to superannuation, tax and financial services law
We will not use your personal information for any purpose unrelated to the services you have engaged us for without your consent.
Who We May Disclose Your Information To
We may disclose your personal information to:
- Other entities within the New Wave Group where necessary to provide integrated services
- The ATO, ASIC, APRA, the Tax Practitioners Board, and other regulatory bodies as required by law
- Your SMSF auditor
- Superannuation fund administrators and custodians
- Investment managers and product issuers
- Insurance companies and financial institutions
- Barristers and other legal professionals engaged in connection with your matter
- Cloud software and technology service providers we use to deliver our services
- AFCA or other dispute resolution bodies where relevant to a complaint
We will not sell your personal information to third parties.
Disclosure Overseas
It is generally unlikely that we will disclose your personal information to overseas recipients. However, some of our technology and cloud service providers may have operations or data storage offshore. Where this occurs, we take reasonable steps to ensure those providers comply with the Australian Privacy Principles and we put appropriate contractual safeguards in place.
How We Hold and Protect Your Information
We hold personal information both physically and electronically on secure internal systems and with cloud service providers. We protect your information by:
- Restricting physical access to our premises
- Using password protection and secure login on all devices and systems
- Maintaining up-to-date security on our computer systems
- Requiring third-party service providers to maintain appropriate security standards
- Training our staff on their confidentiality obligations
When your personal information is no longer required and we are not legally required to retain it, we will take reasonable steps to securely destroy or de-identify it.
Retention of Records
We are required by law to retain certain records for specified periods, including under ATO and superannuation legislation, the Corporations Act 2001 (Cth), and the Legal Profession Act 2007 (Qld). Where personal information is no longer required and we are not legally obligated to retain it, we will take reasonable steps to securely destroy or de-identify it.
Accessing and Correcting Your Information
You have the right to request access to the personal information we hold about you, and to ask us to correct any information that is inaccurate, incomplete, out of date or misleading. To make an access or correction request, please contact our Privacy Officer using the details below. We may charge a reasonable fee to cover the cost of providing access.
Complaints About Privacy
If you believe we have breached this Privacy Policy or the Australian Privacy Principles, you may lodge a complaint with our Privacy Officer. We will acknowledge your complaint and endeavour to respond within 30 days.
If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
For complaints relating to legal services provided by New Wave SMSF Pty Ltd, you may also contact the Queensland Legal Services Commissioner at www.lsc.qld.gov.au or by phone on 1300 655 754.
In accordance with the Notifiable Data Breaches Scheme, if your personal information is involved in a data breach likely to result in serious harm, we will notify you and the Australian Information Commissioner.
Changes to This Policy
We may update this Privacy Policy from time to time. The current version will always be available on our website.
